October 12, 2017: Over 50 Groups and Several Prominent Climate Leaders and Public Figures Urge DEC to Challenge FERC on VLP
Our statement in response: “Protect Orange County sent Governor Cuomo and the DEC a letter yesterday signed by over 50 community and environmental groups, along with notable climate leaders and public figures urging them to protect our water and maintain state jurisdiction over water quality. We are pleased that DEC listened to our concerns and is defending the rule of law. We agree that a permitting agency cannot properly review an application if there is missing or incomplete information. The public hearing held by the DEC yielded 6000 comments raising several new concerns about risks to our water supply such as the presence of a toxic chemical dump in the middle of the pipeline alignment. DEC continues to have the right as well as responsibility to ensure that these issues are addressed before any construction activity is allowed to proceed.We also understand how critical water is to our well-being. Today’s filing indicates that they further understand the enormous risks this project poses. We know that this is company with enormous influence, so we commend DEC’s responsiveness to ongoing public concerns.”

Statement by POC on FERC’s override of NYS jurisdiction of the lateral pipeline:
Many people have been asking us about the recent FERC decision. Below is our statement:
We’re not surprised by CPV and Millennium’s attempt once again to avoid addressing the impacts to air and water quality. They’ve been getting away with this from the very beginning. However, 6000 comments were submitted to the DEC documenting significant threats to water quality and species habitat from the proposed Valley Lateral Project. DEC took an enormous risk with our water by rejecting the permit on procedural grounds rather than substantive water impacts. Now they have a legal and moral responsibility to defend that decision, immediately request a stay from the appropriate court, and ensure that the rights of New Yorkers are preserved.
This is now beyond just Orange County and this one project. This is a matter of state’s rights in the face of egregious federal overreach.
Millennium is seeking to circumvent the state’s authority. Cuomo and the DEC can regain control by rescinding the state permits and pulling the plug on CPV once and for all.

The indictment of aides close to Governor Cuomo and Competitive Power Ventures executive Galbraith Kelly validates what residents of Orange County New York have long suspected, that the CPV Valley Power Plant and its related facilities would never have been approved absent undue influence. “When you look at all the public health impacts and environmental conditions that were systematically ignored there is only one conclusion, that there were other motivations and incentives at play,” said Pramilla Malick of Protect Orange County, a local organization that has been opposing the project for several years. The group has been urging Governor Cuomo to shut the project down immediately pending the investigation, but those pleas have also been ignored by the Cuomo administration which announced its own investigation several months ago. Mr. Percoco’s work with CPV was related in particular to the company’s plans to build a power plant in the Hudson Valley, one person said, a matter that required layers of approvals from the state. Mr. Percoco earned tens of thousands of dollars from CPV as a consultant, this person said.
CPV has announced plans to build a natural gas-powered electrical generating facility in the Lower Hudson Valley.
