Is the New York Times covering up for Competitive Power Ventures? Why has there been such little coverage and investigation of a corruption story that reaches the highest level of government in the state of New York?
Is the NYT Covering CPV? Or Just Covering Up?
When news broke six weeks ago that a court had ordered the Cuomo administration to release records to the NYT pursuant to a Freedom Of Information request seeking facts related to an ongoing federal investigation involving top Cuomo aides and Peter Galbraith Kelly executive for Competitive Power Ventures, we were relieved that good investigative journalism, though late, would soon begin to shed light on this critical story. Afterall, not only does the story involve a muckraker’s ultimate target, corruption; but it involves a company that does business around the country, a Governor with Presidential ambitions, the undue influence over public policy on the highly controversial process of fracking, and climate change (a topic often featured in The NYT headlines).
Moreover, here is a corruption story involving the highest levels of Government in the state of New York, and this is the NEW YORK Times. But six weeks later, on the eve of what will be the final decision on this project to be issued by the State Department of Environmental Conservation, under the direction of Governor Andrew Cuomo, and there is strangely no mention of this in New York’s official paper of record, The Times. Our initial bewilderment has now developed into outrage.
The story first broke more than a year ago that the Governor’s top aides were being investigated by U.S. Attorney Preet Bharara. Our organization, Protect Orange County, has been leading a very public challenge to the irregularities in this case which subsequently became the subject of federal indictments. Surprisingly, no New York Times reporter contacted us to to investigate our experience with the company or review the voluminous information we had compiled which suggested corruption of the permitting process.. We had repeatedly claimed that corruption was influencing state agencies years before the official investigation was announced.
Dennis Kucinich, the former chair of a congressional investigative subcommittee, became an advocate for our community when he studied the egregious approval process and the obviously inappropriate political influence it was based upon. He publicly called for an investigation in January of 2016. Yet still no one from The NYT even once came to our community or reached out to us to inquire about the allegations of impropriety underlying the project.
This story and the imminent decision on its connector pipeline has national implications central to both our climate crisis as well as the crisis in our Democracy. They are both caused by one and the same, corruption. Where does this corruption lie, how does it operate, and what are the consequences? These are fundamental questions. Isn’t the New York Times supposed to be pillars of a free press? If so, there’s a serious crack in the NYT foundation.
Our organization, Protect Orange County, contacted the NYT to inquire if their op-ed page had any interest in the significance of the corruption which has resulted in perversion of justice. The NYT expressed strong interest. We submitted an article. The NYT asked us to make some changes. We did. Just prior to expected publication, the NYT backtracked. An editor said it was too local of an issue and they didn’t have space in the “local” section.
Local? Perhaps they need to take “New York” out of their name. The purpose of the op-ed was to appeal to the Governor not to approve the water permit for the lateral pipeline intended to fuel the CPV project. There is a compelling public interest in informing the people of the Hudson Valley of the severe environmental consequences of the Valley Lateral Pipeline. It defies credulity that The NYT last year published an op-ed critical of the Constitution Pipeline, yet when with faced with revelations of corruption of the Valley Lateral Pipeline process The Times loses interest.
While The Times has covered the indictment and court appearances of the top aides of the Governor, it has relegated corruption of the permitting process to the status of a non-story. If major players connected to the Governor’s office and CPV are under indictment, why hasn’t The NYT exposed the underlying case which threatens the health and safety not only of the people of the Hudson Valley, but all New Yorkers?
In past few years every community facing a CPV power plant has experienced high pressure tactics, backdoor dealing, and the use of undue political influence on the regulatory process . Where has the NYT been? A simple web search reveals an alarming pattern.
Although a NYT reporter was present at the last court appearance of the Governor’s aide and interviewed us for a half hour, the next day there was no story; not of the court appearance, not of our interview. What happened?
Our organization, Protect Orange County, does not seek attention for itself, but we demand attention to the destructive undermining of the democratic process, the corruption of high-ranking state officials by a powerful corporation, and the potential damage to the environment, health, and safety of the people of New York.
We wish the NYT shared our concerns, but the Times is missing in action. The question is why?

The indictment of aides close to Governor Cuomo and Competitive Power Ventures executive Galbraith Kelly validates what residents of Orange County New York have long suspected, that the CPV Valley Power Plant and its related facilities would never have been approved absent undue influence. “When you look at all the public health impacts and environmental conditions that were systematically ignored there is only one conclusion, that there were other motivations and incentives at play,” said Pramilla Malick of Protect Orange County, a local organization that has been opposing the project for several years. The group has been urging Governor Cuomo to shut the project down immediately pending the investigation, but those pleas have also been ignored by the Cuomo administration which announced its own investigation several months ago. Mr. Percoco’s work with CPV was related in particular to the company’s plans to build a power plant in the Hudson Valley, one person said, a matter that required layers of approvals from the state. Mr. Percoco earned tens of thousands of dollars from CPV as a consultant, this person said.
CPV has announced plans to build a natural gas-powered electrical generating facility in the Lower Hudson Valley.
